End-User License Agreement


 

This license agreement is a legal agreement between you (either an individual or a company) and the author of this software package,

By installing or otherwise using this software you agree to be bound by this agreement. If you do not agree to be bound by the terms of this agreement, you may not install or use this software.

 

All intellectual and other rights to this software are owned by the author of this software.

 

Evaluation Version

You may give copies of the unregistered SOFTWARE (shareware version) of this software package to anyone, copy it to any media, distribute it by any means, and upload it to shareware sites on the Internet, as long as the original install package remains unmodified.

 

Registered Version

One registered copy of this software may either be used by a single person who uses the software personally on no more than two computers, or installed on a single workstation used non-simultaneously by multiple people, but not both.

 

You may access the registered version through a network, provided that you have obtained individual licenses for the software covering all workstations that will access the software through the network.  Each workstation must have its own license, regardless of whether usage is concurrent or at different times.  You must have a reasonable mechanism in place to ensure that the number of Client Devices on which the Software Product has been installed does not exceed the number of licenses you have obtained.  

 

You may not modify, disassemble, hack or reverse-engineer any part of this software.

 

Disclaimer of Warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE AND DOCUMENTATION ARE PROVIDED "AS IS" AND THE AUTHOR DISCLAIMS ALL WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, CONFORMANCE WITH DESCRIPTION, TITLE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AUTHOR BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES OR LOST PROFITS WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF THE AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

GOOD DATA PROCESSING PROCEDURE DICTATES THAT ANY PROGRAM BE THOROUGHLY TESTED WITH NON-CRITICAL DATA BEFORE RELYING ON IT.  ALSO, PRIOR TO THE USE OF THIS SOFTWARE WITH ANY DATA, A COMPLETE BACKUP OF THE DATA SHOULD BE MADE (AND RETAINED UNTIL IT IS DETERMINED THAT THE MODIFICATIONS MADE BY THIS SOFTWARE ARE CORRECT AND HAVE HAD NO UNDESIRED EFFECTS). THE USER MUST ASSUME THE ENTIRE RISK OF USING THE PROGRAM.  ANY LIABILITY OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE.

 

Customer Support

Support for licensed (registered) users and also Beta Testers, is available via the Osage Computing Services, Inc. Web site (http://www.OsageComputing.com), or via a command button in the About Box of the add-in.  OCSI receives error reports via electronic mail.  If you encounter errors during your use of the SOFTWARE, please go to our Web site and verify you have the latest product release and also review any error fixes published on the site BEFORE submitting an error report.  Error reports will be processed based upon the criticality of the error as determined by OCSI.  OCSI makes no warranties as to the proper function of user workstations (PCs), user network environments, Microsoft® Access or other Microsoft® components that may impact the proper function of the SOFTWARE PRODUCT.

 

Should any term of these terms and conditions be declared void or unenforceable by any court of competent jurisdiction, such declaration shall have no effect on the remaining terms hereof.
